On October 28, 2013 I filed a Petition to contest the results of the October 15, 2013 Special Election Runoff results between me and candidate Larry Schlesinger. The results that were certified by the Macon-Bibb Election Board had candidate Schlesinger with a 26 vote margin of victory. Based on what at the time were unconfirmed reports of significant numbers of voters who should have been able to vote in the District 2 race but were not able to vote in the race, I hired a legal team to investigate the situation.

We have now substantially completed our investigation which conclusively reveals that at least 50 and possibly as many as 53 voters who reside in the Overlook Gardens apartments were not able to vote in the October 15, 2013 Special Election Runoff. Our conclusions are based upon phone interviews with voters who reside in the Overlook Gardens apartments, and an analysis of records maintained by the Georgia Secretary of State, the Kennesaw State College Elections Center and the Macon-Bibb County Board of Elections. We believe our conclusions are irrefutable and cannot be rationally disputed as we can identify each and every voter who by virtue of a systemic error was prevented from voting in the October 15, 2013 Special Election Runoff.

Buildings 1 - 8 of the Overlook Garden apartments are physically and geographically located in District 2. Buildings 9 - 12 of the Overlook Garden apartments are physically and geographically located in District 3 by virtue of the legislation creating the consolidated Macon-Bibb County Board of Commissioners. Due to a coding and assignment of voters error all residents of the Overlook Garden apartments were coded into District 3 for the October 15, 2013 Special Election Runoff. Therefore, when these voters voted there was no District 2 race appearing on the electronic voting machines that they voted on, nor if they voted early, or by absentee mail-in ballot, did they receive a ballot with the District 2 race contained on the ballot. We have confirmed these facts through the relevant and appropriate election officials. To date we have identified 53 District 2 voters who voted in the October 15, 2013 Special Election Runoff who were mistakenly and erroneously denied the opportunity to vote for a candidate in the District 2 race.

Since the margin of victory between me and candidate Schlesinger was only 26 votes, had these 53 voters, that we have identified, been given the correct ballot, the outcome of the election could have been differently decided. It is for this reason that I have filed the Petition to contest the results of the October 15, 2013 Special Election Runoff.
